Terms of Use

These Terms of Use (the "Terms") are a legal agreement between you and ICEProof ("ICEProof", "we", "us") and govern your use of the ICEProof mobile application and the iceproof.app website (together, the "App"). By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

These Terms also serve as the End User License Agreement (EULA) for the App on the Apple App Store and Google Play.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and the usage rules of the app store you obtained it from.

• You may not copy, modify, distribute, sell, rent or sublicense the App, or reverse engineer, decompile or attempt to extract its source code, except where the law expressly permits it.
• You may not use the App in any way that is unlawful, that harms others, or that interferes with the App or its services.
• The App, including its design, text, graphics and code, is owned by ICEProof or its licensors and is protected by copyright and other intellectual property laws. All rights not expressly granted to you are reserved.

ICEProof Premium is offered as an auto-renewing subscription purchased through Apple In-App Purchase (on iOS) or Google Play Billing (on Android). The plans, their lengths and their prices are shown in the App before you subscribe and in your app store account. At the time of writing they are:

• Individual Monthly — 1 month — US$4.99 per month
• Individual Annual — 1 year — US$49.99 per year
• Family Monthly (up to 6 people) — 1 month — US$9.99 per month
• Family Annual (up to 6 people) — 1 year — US$99.99 per year
• Prices are shown in the App in your local currency and may vary by country. Payment is charged to your Apple ID or Google account at confirmation of purchase.
• New subscribers may be offered a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, your subscription starts and you are charged for the plan you chose. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Subscriptions renew automatically for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your device account settings (iOS: Settings › Apple Account › Subscriptions; Android: Google Play › Payments & subscriptions). Deleting the App does not cancel a subscription. Cancellation takes effect at the end of the current billing period; there are no partial refunds for the remainder of a period.
• Refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through an app store.
• We may change subscription prices. Any change applies from your next renewal, and you will be notified in advance as required by your app store, with the opportunity to cancel.

The App provides general information about rights and about immigration documents for educational purposes only. It is not legal advice, does not create an attorney–client relationship, and may not reflect the most current law or the law in your jurisdiction. Laws differ by country, state and situation. For advice about your circumstances, consult a licensed attorney or an accredited representative.

The App can send alerts, your location and other information to contacts you choose, using your device's messaging, telephone and location services. These features depend on your device, its settings, its battery, mobile network coverage and the availability of third-party services, none of which we control. Alerts may be delayed or fail to send.

The App is not an emergency service and is not a substitute for contacting emergency services. If you are in danger, call your local emergency number.

Documents, contacts and settings you add to the App are stored on your device, encrypted with a key derived from your PIN. We do not have a copy and cannot recover them if you forget your PIN, lose your device or delete the App. You are responsible for keeping your PIN secure and for keeping copies of important original documents. How we handle information is described in our Privacy Policy.

You agree that you will not:

• Use the App to store or share content that you do not have the right to store or share, or that is unlawful.
• Use the alert features to harass, threaten or deceive anyone, or to send false emergency alerts.
• Interfere with, disrupt or attempt to gain unauthorised access to the App, its services or any related systems.
• Use the App for any purpose that is illegal or that these Terms prohibit.

The App relies on services provided by others, including Apple, Google, your mobile carrier and mapping and messaging providers. Your use of those services is subject to their own terms, and we are not responsible for them.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, ICEPROOF AND ITS OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF DOCUMENTS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING ANY FAILURE OR DELAY OF ALERT, LOCATION OR MESSAGING FEATURES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limitations, so some of the above may not apply to you.

You may stop using the App at any time by deleting it (remember to cancel any subscription separately). We may suspend or terminate your license if you breach these Terms. Sections 4, 6 and 9 through 14 survive termination.

If you obtained the App from the Apple App Store, the following also applies. Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies to the extent these Terms do not cover a matter.

• These Terms are between you and ICEProof only, not Apple. Apple is not responsible for the App or its content.
• Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• ICEProof, not Apple, is solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• ICEProof, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar laws.
• In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, ICEProof, not Apple, is responsible for the investigation, defense, settlement and discharge of the claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

We may update these Terms from time to time. The "Effective date" at the top of this page shows when they were last changed. Material changes will be announced in the App or on this website. Continued use of the App after a change means you accept the updated Terms.

These Terms are governed by the laws of the United States and of the state in which ICEProof is based, without regard to conflict-of-law rules, except where the law of your country of residence gives you rights that cannot be waived. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor. These Terms and the Privacy Policy are the entire agreement between you and ICEProof about the App.
